Objectives of the assignment The Transitional Federal Charter of the Somali Republic (2004) came out of the IGAD sponsored 2002-2004 peace negotiations facilitated by Kenya. A new Federal Constitution was to be drafted and adopted by popular referendum during the final year of the five year transitional period but the volatile security and political environment in south central Somalia since 2006 has not been conducive to the progress of the constitution making process. However, recent positive developments in reconciliation between the TFG and the Alliance for the Re-liberation of Somalia (ARS) have led to an agreement to work together to address unresolved security and political issues in Somalia and specifically to establish a joint commission to facilitate the constitution making process. UNDP has been asked to assist and provide support to the joint commission. This will include providing to the ARS Committee for Constitutional Affairs the same basic training that was given to the Independent Federal Constitution Commission in August 2008. UNDP wishes to therefore recruit a short term consultant to provide the following trainings: reviewing of the 1960 and 1990 constitutions, the Transitional Federal Charter of 2004 and an initial three month work plan for the joint commission. III. Scope of work The outputs to which the consultants will contribute will be: 1. Reviewing of the 1960 Somali constitution. 2. Reviewing of the 1990 Somali constitution. 3. Reviewing of the 2004 Transitional Federal Charter. 4. Conducting a training workshop to: a. Explain provisions of the 1960 and 1990 constitution and 2004 charter to the committee. b. Develop a structure for the new draft constitution. c. Compile articles (from the 1960, 1990 and 2004 Charter) that may be included in the new draft constitution. 5. Developing an initial 3 month work plan for the joint committee in line with the outcomes of the December Federalism Conference. IV. Monitoring and Progress controls The consultants will work under the overall supervision of the Constitution Building Project Manager. A work plan for the consultancy will be developed and agreed to no later than two days after the start of the assignment. Evaluation of the SSA contract will be made against the benchmarks and deliverables set for the assignment of the consultant at the end of the contract duration. V. Final product/deliverable 1. Chapter by chapter comparative analysis of the 1960 constitution, the 1990 constitution and the 2004 Transitional Federal Charter. 2. Structure for the new draft constitution developed. 3. Articles (from the 1960, 1990 and 2004 Charter) that may be included in the new draft constitution identified. 4. Detailed report that includes: a. The agreed core articles for a draft constitution, b. Identifies any issues / provisions that pose challenges by way of disagreement or knowledge gaps and require further training, capacity building or discussion with the technical team. 5. An initial 3 month work plan for the joint committee. VI: Review/approval time The performance of the contractor will be reviewed on bi-monthly basis to approve outputs prior to authorization of payments. VII: Qualifications University degree in Constitutional Law. At least 10-15 years of relevant work experience. Strong constitutional drafting experience Prior experience in constitution making processes Demonstrable knowledge of or experience in Somalia is an advantage VIII.
