II. Objectives of the assignment


The overall aim of the UNDP Somalia country office outcome (before the establishment of the UN Transition Plan for Somalia, UNTP), was to build state capacity for balanced and decentralized development through strengthening of human and institutional capacities and early recovery strategies.  Within this context, UNDP Somalia has since 2001 supported the Somaliland Cadastral Surveys (SCS), to provide secure land tenure arrangements for the non-demarcated farms with the objective of creating legal farm boundaries and establishing law and order among the farming communities. The aim of the project is to contribute to the reduction of conflicts, disputes among the farming communities and secure freehold title deeds which enable farmers to acquire collateral to raise loans for other livelihood ventures. The identified output for the project period 2006-2009 is that secure land arrangements are increased through dialogue and local capacity building. By Feb 2008, total farms surveyed and mapped are 10,800; however, 850 of these farms have received Title Deeds from the Ministry of Agriculture. The Title Deeds have been distributed to the farm owners by the Ministry of Agriculture. Ministry of Agriculture staff has received training in surveying skills to allow them to carry out the surveying in the field. The Royal Danish Government has been providing the funds to the project for the past two years. In an effort to review the relevance of the project to the aim of the UNTP, UNDP will review the SCS implemented project to assess its management implementation procedures and the efficiency of the project.

The objectives of the review is to assess the impact of the project and the extent to which it has contributed to the reduction of land and farm related conflicts, and provide recommendations on the way forward.

The role of the consultant is:

(i) In consultation with local counterparts and stakeholders, review the results of the project compared to objectives and outputs which were set out in the project document. Assess the level of impact of the project (in particular with respect to conflict resolution and livelihoods) as well as the current implementation arrangements. Review the roles of the various partners in the project. Review whether the main objective of the project: enhanced land security through the provision of title deeds and reconciliation, has been achieved.
(ii) Highlight lessons learned and results which can be seen as good or bad practices
(iii) Provide recommendations on the way forward.
III. Scope of work

The consultant will use a total of 20 working days to complete this assignment. The assignment will be carried out in three steps. The first step requires review of project documents, review of the TOR, design of a simple Inception Plan, and security briefing in Nairobi. 3 working days are required for this and it is anticipated to take place in Nairobi in March 2008. The second step is the review stage and is calculated to 14 working days in Somaliland. The third stage is the drafting of the review report and the presentation of it, and 3 days are set aside for this in Somaliland/Nairobi.
Step 1
• Review the project document and relevant reports, review the TOR, and discuss the implementation of the assignments with the project manager in Nairobi.
• Meet with relevant partners, in particular the Danish Embassy
• Design a simple Inception Report at maximum 4 pages identifying the major issues to be addressed in the consultation with the various stakeholder, and a detailed workplan.
• Conduct the necessary training for security clearance for Somalia (and Kenya if relevant).

Step 2
The consultant shall meet, among other, with Government institutions including the Ministry of agriculture, Ministry of Interior, regional coordinators of the ministries of agriculture and Interior, Mayors of relevant urban and  district councils, project beneficiaries including the farmers and families in the current project areas, cadastral survey staff in Hargeisa and in the field, and cadastral survey field teams, UNDP governance staff at in Hargeisa and Nairobi in order to address the following:

Impact of project on reduction of land conflicts and peace building
• Assess the impact of the project and how well it has contributed to the reduction of land/farm related conflicts. Establish the rate of land disputes now existing among the agricultural communities of Awdal and W/Galbeed regions in comparison with the rate of incidence in the 1990s before the project started.

Impact of project on livelihoods of beneficiaries
• Assess the impact of the project on the livelihoods of the beneficiairies.
• .

Identification of lessons learned
• Identify and elaborate the lessons learnt and how the project can be adopted/adapted/replicated in other parts Somalia where land conflicts are widespread due to lack of land demarcation.

Sustainability
• Assess the degree of sustainability of the project and the sustainability strategy which has been put in place
• Determine the role and capacity of the Ministry of Agriculture in the process of registration of farms, issuance of Title Deeds to farmers and cadastral surveying.

Project management capacity and relationship with counterparts
• Assess the relationship between the implementing NGO, Ministry Agriculture and the local authorities at the district and village level with regard to achieving the stated goals of the project, and recommend ways to address challenges in the project implementation.
• Appraise the strengths and weaknesses of the current set-up and the quality control and financial management mechanisms that have been put in place.
• Review the efficiency and effectiveness of the project and recommend potential changes to improve efficiency and effectiveness.
• Review the possibility of further integrating project implementation into government institutions.
• Examine the monitoring of the implementation plan against the agreed timelines, disbursement of funds by UNDP to the project and establish any bottleneck, their causes and remedies for the future.
• Assess the capacity of SCS and the Ministry of Agriculture to expand its activities to the other regions of Somaliland.

Step 3
• At the end of the stay in Somaliland, present the findings in a power point presentation addressing to all relevant stakeholders in Hargeisa addressing all aspects of this TOR. The presentation shall be preceded with a summary of the key findings.
• Arrange a debriefing with relevant partners in  Nairobi, including the Danish Embassy
• Present a draft Review Report to UNDP no later than 16 working days after the start of the assignment.
• Review comments and present a final report no later than one month after the start of the assignment.

IV. Monitoring and Progress controls


The consultant will work under the overall supervision of UNDP/the Project Manager for Local Governance. Progress will be measured according to the deliverables below.
